It’s sad to see lax plea deals arranged in serious cases where deaths are involved, but that was the reason behind the sentence of only 15 years in the drunk-driving crash that took the lives of Diane Bronson and her daughter Anna. The two were killed in a head-on smash-up with illegal alien Mexican Felix Solano-Gallardo who was driving in the wrong lane for an estimated 14 miles and had a blood alcohol level of twice the legal amount. An earlier news report noted that Solano-Gallardo could have gotten a sentence of up to 35 years.

The video below mentions that the prosecution asked for 68 years imprisonment. Buddy Bronson, Diane’s husband and Anna’s dad, did not believe justice was served with such a lenient sentence.
A Jackson County judge sentenced a 19-year-old Mexican man Friday to 15 years in prison for driving drunk and killing a Belton woman and her 11-year-old daughter.
Felix Solano-Gallardo admitted in January that he was driving the wrong way on Interstate 435 near 63rd Street when he crashed into a car carrying Diane Bronson, 44, and her daughter, Anna Bronson.
He also admitted that his blood-alcohol level that day was more than twice the legal limit.
Solano-Gallardo could have received up to 30 years in prison under his plea agreement. He received two 15-year sentences, which will run concurrently.
Police said they believed Solano-Gallardo had been driving the wrong way for at least 14 miles because they think he ran a driver off of Interstate 70 into a concrete median near Harrison Street earlier. The victim told police the driver drove at him from one side of the highway to the other and appeared to be trying to hit him, police said.
At least nine motorists called 911 to complain about a wrong-way driver on I-70 or I-435 that morning. Continue reading this article
Milford Massachusetts has already suffered too much illegal alien violence with the dragging death of young Matthew Denice at the hands of a lawbreaking Ecuadoran, Nikolas Guaman. Now the accused killer’s brother has been arrested for stabbing another man.
Below, diverse criminals David and Nikolas Guaman are an example of criminal family values among illegal aliens.
Despite a “severe cutting,” the victim is expected to survive, no thanks to David Segundo Dutan Guaman, who knifed the guy at a party. Like his older sibling, David had previous arrests but was not deported.
The Denice family is still engaged on the issue and spoke out against the policies that protect dangerous foreigners. They have a spokesperson, shown in the video below, and released a statement on the recent case, included in the print story following.
David Segundo Dutan Guaman is charged with armed assault after a stabbing at his home on Water Street in Milford early Saturday morning. He is an illegal immigrant, and was wanted on warrants in connection with driving violations.
His brother, Nicolas Guaman, is charged with driving a pick up truck that struck and killed Matthew Denice last August.
Another brother, Pablo Guaman, is charged with giving Nicolas the truck. He is out on bail, wearing a monitoring bracelet.
ICE officials say at this point it appears David was not in their system. State officials confirm they did not have any fingerprints from him prior to the weekend stabbing. Now, ICE has launched a retainer against David Guaman, which means if he is let out of custody, ICE has 48 hours to take him into custody.
Milford’s Police Chief Thomas O’Loughlin says this case is a reminder to the community of Matthew Denice’s death, and the frustrations with the lack of comprehensive immigration reform. He says if the program, Secure Communities, was in place in Massachusetts, David would not have been identified because he hadn’t been arrested in a violent crime; however, he says other measures are needed to strengthen immigration laws. He says, “When is the federal government going to do something about individuals such as David Guaman and his brother? Until they do something, local police and state police we are in the middle dealing with the issues.”
Wendy Murphy, who represents Matt’s family, says, “Mathew Denice’s family is very distraught to hear there is, in a sense, the same kind of problem in this case.” Both men are illegal immigrants and both have driving records. Murphy says, “It looks like there is a systemic problem, in the sense that people who are here illegally, and are being coddled by the legal system, are escalating their illegal behavior, and we’re seeing acts of violence.”
Murphy says while Secure Communities would not have lead to David’s deportation before the stabbing, it is a tool that could help collected data and monitor crimes. She says Governor Patrick should reverse course and ask for it to be implemented to help understand the facts. “The public has a right to be angry, and has a right to ask political leaders of the state, why aren’t you measuring the problem?”
Governor Deval Patrick has opposed the Secure Communities program. Last year, ICE announced it will be implemented in every state by the end of 2013.
11.2 million people live in the United States illegally. Officials with ICE say they can only deport 400,000 people per year because of their financial resources. For that reason, they say they focus on deporting violent criminals.
David Guaman will be arraigned on Tuesday in Milford District Court.
The victim in the stabbing is expected to survive.
The Denice family released the following statement:
“Despite all the promises that were made by local officials, politicians, and leaders in the Ecuadorian community after our son Matthew Denice was killed, David Guaman, like his brother Nicolas, who killed Matthew, should not have been free to become involved in more serious violence. We are extremely concerned that despite all the promises that were made, about how things would soon improve and that the public would be better protected, nothing much has changed. Unlicensed drivers are cited on a daily basis, many of them after being involved in accidents or for being pulled over for driving drunk. Without proper training, passing a written test and a road test these drivers put all of our lives at risk on a daily basis. In Milford there has been a huge increase in excessive drinking that has resulted in several violent assaults over the last few months like this most recent stabbing by David Dutan-Guaman.
Our son Matthew Denice paid the ultimate price with his life because Nicolas Dutan-Guaman, who was in the country illegally, had a criminal record, and was unlicensed, chose to get drunk and drive. We are still deeply disappointed that when Govenor Patrick had the opportunity he did not chose to participate in the Secure Communities Program that would eventually lead to deportation of the most serious offenders illegally in our country.”
According to Human Events, Senator Charles Grassley got an amendment passed in the Judiciary Committee that would make “habitual” drunk driving — meaning three arrests — cause for deportation.
Say, what’s wrong with one DUI being the deportation marker? The Grassley change would not have saved Sister Denise Mosier from drunk Bolivian Carlos Montano, who had two previous DUI arrests before the third one which killed the Virginia nun.
The Grassley amendment would not have saved young Matthew Denice (pictured) from being dragged to death by a drunk illegal alien from Ecuador. Nicolas Guaman had several previous arrests, including the assault of a police officer, but there were no earlier DUIs, and he was not deported.
A better idea would be the Scott Gardner Act first introduced by Rep Sue Myrick (R-NC) in 2005: the upshot of which is “You’re drunk, you’re driving, you’re illegal, you’re deported, period.”
For some reason, the Human Events report emphasized Obama’s illegal alien Uncle Omar. At least he didn’t kill anyone, unlike many other drunk-driving illegal aliens; you can say that in his favor.
America’s favorite drunk-driving illegal alien uncle could be on his way home if he continues his drunk driving ways. At its Feb. 2 meeting, the Senate Judiciary Committee voted 18-0 to pass an amendment by Sen. Charles E. Grassley (R.-Iowa), which would change current statutes to make habitual drunk driving cause for deportation, but Democrats voted to strike language that would have made the provision retroactive. Habitual drunk driving is defined as having three DUI convictions. If it was retroactive, it would mean bittersweet homecomings for many out-of-status visitors to our shores.
It would also mean a difficult situation for “sanctuary” cities and towns that do not report illegal aliens they encounter to federal authorities. If each new drunk driving conviction equals one third of a guaranteed deportation, immigration law nullifiers may start charging drunk driving illegals with something else. Twenty years doesn’t seem an adequate sentence for a death caused by drunk driving, but Judge Jon Farris thought the illegal alien killer’s apology was touching enough to merit a lowered sentence, and family tears were shed on behalf of the perp in court as well. Neither of the surviving victims appeared, who were seriously injured in the crash.
Not only was there an emotional apology, the killer said he found god in jail and had quit drinking. Plus, he says he wants to become an ordained minister.
So uplifting.

The case was a big embarrassment to the Obama administration which had professed to creating an immigration system that was tough on dangerous criminals and not so hard on the proverbial busboys. Unfortunately for Obama, the crash that killed Sister Denise Mosier occurred not far from Washington and couldn’t be ignored in the capital city. DHS Secretary Napolitano withheld records about the case which increased the suspicion that it was even dirtier than it appeared.
Plus, the DHS snooze-through illustrated how the federal government still does not regard drunk driving seriously enough to deport the dangerous foreigners who drive drunk. The agency promised to do better in the future, but that remains to be seen.
Carlos Martinelly Montano, a 23-year-old Bolivian national who had been set for deportation before he was convicted of killing a Prince William County nun and injuring two others in his third DUI offense, was sentenced Friday to 20 years in prison.
Martinelly Montano pleaded guilty in October to lesser charges of driving while intoxicated and driving without a license. During his trial, he was found guilty of felony murder.
At the last second before he was sentenced for killing a nun in a drunk driving crash, he asked to speak. Clutching a hand written letter, he read his statement to Judge Lon Farris.
“I am truly sorry,” Montano said. “I feel terrible. I have agonizing pain in my heart.”
“Ever since the accident, I have been deeply moved for the life and the damage I inflicted upon the sisters.”
Martinelly Montano admitted he was drunk while driving in Brisow on Aug. 1, 2010 when he hit a car carrying Sisters Denise Mosier, Charlotte Lange and Connie Ruth Lupton. Mosier was killed, while Lange and Lupton were both seriously injured.
He says he had a drinking problem that lead to the decision he made that morning.
While they were not in the courtroom today, Martinelly Montano says the other nuns have forgiven him for the death of Mosier. He says that mercy helped him fight off alcoholism and find religion in jail.
“I’m ready to take full responsibilty for my actions and I accept the consequences,” he told the judge.
No one representing the nuns was present during today’s sentencing.

The preventable death of Matthew Denice illustrated how little the state of Massachusetts cares about public safety for citizens. The accused Ecuadoran, Nikolas Guaman, had several prior arrests, including assaulting a police officer. Democrat Governor Deval Patrick was particularly egregious in defending the state’s sanctuary policy that protected the killer alien. Senator Scott Brown urged the governor to adopt Secure Communities statewide, but Patrick wouldn’t budge.
Ed Kowalski, the uncle of murdered high school student Elizabeth Butler, has testified before elected officials in New York and Arizona about the crimes committed by illegal aliens.
The older brother of the Milford man whose death in a motorcycle accident spurred furious debate about illegal immigration has announced his intention to run for selectman this spring.
Michael Denice, 26, who lives at 22 Debbie Lane, has taken out nomination papers and has set up a Facebook page about his candidacy.
If Denice makes the ballot, he would likely face Dino DeBartolomeis, who is seeking his 11th term on the board.
“The citizens of Milford need a voice on town issues. I have seen many changes occur in Milford over the past several years, including a rise in crime, an increase in immigration-related issues and a decline in the local economy and businesses,” Denice said in a statement. “We need selectmen that will not only work for the people, but more importantly work with the people in the community.”
Denice is the brother of Matthew Denice, 23, who police say was dragged to his death Aug. 20 by a pickup truck driven by Nicholas D. Guaman, an Ecuadorean who is in the country illegally. Police say Guaman was drunk when he hit Denice, who was riding his motorcycle at Congress and Fayette streets.
Guaman has been charged with second-degree murder, manslaughter while driving, motor vehicle homicide while under the influence, among other charges.
At a September forum in Town Hall designed to clear the air about the local Ecuadorian community, Michael Denice chided Ecuadorean officials, complaining that illegal immigrants have to work under the table, cannot drive with a legal license and must violate other laws just to stay in the country.
“What is your solution for those illegal immigrants already here today?” he asked, prompting a standing ovation from a crowd at Town Hall.
We little citizens are supposed to celebrate New Year’s Day, but in backwards Mexifornia, that’s the date when the bad new laws go into effect. So the holiday also has a strong batten-down-the-hatches aspect.
One of the worst concoctions from Sacramento this year is the law that prohibits the impounding of cars driven by unlicensed drivers. It was enacted in October to make life easier for illegal aliens.
It used to be the law that unlicensed drivers snagged in checkpoints or during traffic stops would lose their vehicles to the impound yard and have to pay a big fine to bail them out. But that was deemed too troublesome for illegal aliens, so the only punishment left to dissuade unlicensed driving was scrapped.
Pandering to illegals makes the roadways more dangerous for the public, but the Mexican tail wags the Democrat dog in the California capital.
In Los Angeles, the policy is already in place, and police are arguing that the political decision is endangering public safety (Impound policy change for unlicensed motorists leads to feud, Daily News, Dec 23). A police union cited the recent death of a pedestrian (Missouri resident Patricia Ellen Riedy) in Panorama City caused by an unlicensed driver:
“This could have been avoided if the driver had taken the bus,” said Officer Kristi Sandoval, who serves on the Police Protective League board. “She could have saved a life if she were willing to be inconvenienced.”

As a police officer I can tell you that when we pull over an unlicensed driver whom is in this country illegally with NO license or insurance (so if they get into a collision you are totally financially responsible for damage / injury even if it is through no fault of your own), also these drivers are also much more likely to leave the seen of an accident as well regardless if you are injured / dying. But back to my original point, I have to give the unlicensed driver twenty minutes to call a friend to come get his or her car (this is the law of our state). Now if you are an American who had a license who somehow got it revoked I (by statute of state law) immediately no questions asked have to tow your car. I have not an ounce of leeway in this matter. How is that fair and equal treatment under the law?
Escondido, Calif. (AP) — Delfino Aldama was fixing a customer’s brakes this month when his smartphone chimed with a text message that tipped him to a police checkpoint more than an hour before officers began stopping motorists. The self-employed auto mechanic frantically called friends with the location and drove an alternate route home.
The Mexico native had reason to be alarmed: He does not have a driver’s license because he is in the United States illegally, and it would cost about $1,400 to get his Nissan Frontier pickup back from the towing company. He has breathed a little easier since he began getting blast text messages two years ago from activists who scour streets to find checkpoints as they are being set up.
The cat-and-mouse game ends Jan. 1 when a new law takes effect in California to prohibit police from impounding cars at sobriety checkpoints if a motorist’s only offense is being an unlicensed driver. Thousands of cars are towed each year in the state under those circumstances, hitting pocketbooks of illegal immigrants especially hard.
When Aldama’s 1992 Honda Civic was towed from a checkpoint years ago, he quit his job frying chickens at a fast-food restaurant because he had no way to make the 40-mile round trip to work. He abandoned the car rather than pay about $1,200 in fees.
“A car is a necessity, it’s not a luxury,” said the 35-year-old Aldama, who lives in Escondido with his wife, who is a legal resident, and their 5-year-old son, a U.S. citizen.
Assemblyman Gil Cedillo, a Los Angeles Democrat who tried unsuccessfully to restore driver licenses to illegal immigrants after California revoked the privilege in 1993, said he introduced the bill to ban towing after learning the notoriously corrupt city of Bell raked in big fees from unlicensed drivers at checkpoints.
A sharp increase in federally funded sobriety checkpoints in California has fueled controversy. The National Highway Traffic Safety Administration paid for 2,553 checkpoints last year, which authorities say helps explain why deaths caused by drunken drivers dropped to an all-time low in the state. It’s reassuring that the heavy hand of the federal government against state immigration enforcement has not scared off everyone. North Carolina is moving in that direction, while being aware of the inevitable punishment down the road, as long as Obama is in charge with Eric Holder as his muscle.
Some NC counties were early adopters of the effective 287(g) program, one form of state-federal partnership, which is how the system should work. The program has racked up impressive numbers, as noted by the Alamance County Sheriff in a recent committee meeting examining legislative proposals (Lawmakers weigh immigration changes, WRAL):
Alamance Sheriff Terry Johnson says his county’s participation in the federal 287(g) program has helped his deputies arrest and arrange for the deportation of nearly 1,800 illegal immigrants over the past five years. All had been charged with a criminal offense, brought to the detention center, and put into a federal fingerprint database to verify their actual identities.
That works out to 360 illegals annually, around one daily in one county alone. It sounds like a lot of crime prevention, from drunk-driving deaths to drug dealing and thefts. Plus it’s likely that word of the county’s tough enforcement got around, making it a less popular landing spot than sanctuary cities which have put out the welcome mat for illegal aliens.
Republicans now in charge of the state legislature are using their clout to push for new laws identifying illegal immigrants and limiting their use of public services.
That effort got its start Wednesday in the House Committee on the State’s Role in Immigration Policy, which drew a crowd representing both sides of the controversial issue. The committee can recommend legislation to be considered next year.
For years, a legislative contingent has focused on more laws limiting illegal immigrants’ access to public services – seeking to bar their admission to community colleges, for example – but they have had limited success.
Republicans won control of the legislature last year, giving their efforts new life. The wave of tough laws in other states such as Arizona and Alabama has given them another reason to act.
With other states tightening their laws, North Carolina could become a magnet for illegal immigrants, said Rep. Bert Jones, a Rockingham County Republican.
Arizona passed a law last year that made being an illegal immigrant and failure to carry immigration documents state crimes.
Alabama this year approved a sweeping law banning illegal immigrants from attending public colleges, prohibiting employers from hiring illegal immigrants, and voiding all contracts with illegal immigrants, among other provisions. Parts of the law are under court review.
No specific laws were mentioned at the committee meeting Wednesday, but the legislature has bills pending that would prohibit use of consular or other embassy documents as official identification, specify documents that must be shown to receive public benefits, and a put an identifying mark on the driver’s licenses of people living in the country temporarily.
A comprehensive Arizona-style immigration bill has been filed, but has not been considered by the House or Senate. Continue reading this article
Thirteen years in prison hardly seems adequate punishment for causing the drunk-driving death of 51-year-old Pamila Yoder (pictured below) in Sarasota, Florida, last November.
The drunk-driving illegal alien, Daniel Garcia, was also listed in critical condition immediately after the crash, but he managed to escape the hospital by walking out the front door the next morning in his gown. He remained at large for several months until he was found thanks to persistent police work on the part of Sarasota County detective Brian Barrett.
Interestingly, Garcia did not flee to Mexico (known to be a friendly hide-out for criminals) but went to Gainesville, which he must have thought was far enough.

SARASOTA COUNTY – Pamila Yoder’s three children thought this day might never come — when the man accused of driving drunk and killing their 51-year-old mother faced a judge.
They drove to the Sarasota County Courthouse this morning from Jacksonville and Miami to watch first-hand as Daniel Garcia, who pleaded no contest to DUI manslaughter, received a 13-year prison sentence.
Garcia, an illegal immigrant from Mexico, had been on the lam for several months after the Nov. 7, 2010 crash in Sarasota that killed Yoder. The family had a hard time healing, knowing the man responsible for Yoder’s death was free.
But Garcia, 26, finally was arrested while hiding out in Gainesville, thanks to the dogged efforts of one of the region’s most aggressive fugitive hunters, Sarasota County Sheriff’s Deputy Brian Barrett.
In court this morning, Yoder’s three children went to the podium together for emotional support, clutching tissues and touching each other on the shoulder. They spoke to Garcia directly.
“I just wanted you to know my face,” Yoder’s daughter, Tavy Chen, formerly Tavy Wells, said to Garcia. “I will never forget what you did. I hope you never forget either.”
Pamila Yoder died at the scene of the crash at University Parkway and U.S. 301; Garcia had been airlifted with grave injuries from the crash and taken to Bayfront Medical Center in St. Petersburg.
The next morning, before he was charged, Bayfront Medical security footage showed him walking out the front door, still in a hospital gown, the I-V still hanging from his arm.
The FHP looked for Garcia, but gave up. Deputy Barrett spent months observing the area’s labor camps, Latin dance clubs and bars, finally getting a break and catching Garcia at a Gainesville apartment complex.
Yoder’s son, Jesse Yoder, said his mother above all valued truth. “I hope that what you are doing here today is because you genuinely want to make some sort of amends,” he said to Garcia. “I know nothing can undo what happened, but I just want you to understand what you’ve done to our family.”
In Milford, Massachusetts, the site of a terrible crime of an illegal alien against a citizen, the lawbreaking foreigners are attempting to portray themselves as the victims, despite substantial evidence to the contrary.
In the face of a criminal surge, the political accomplices burp out twisted excuses, saying that the foreigners don’t commit crimes because they need to keep their heads down out of concern about their status.
However, actual measurements of behavior paint a different picture. The 2011 GAO study titled CRIMINAL ALIEN STATISTICS reported, “In fiscal year 2005, the criminal alien population in federal prisons was around 27 percent of the total inmate population, and from fiscal years 2006 through 2010 remained consistently around 25 percent.” The percentage of illegal aliens in the general population isn’t near that number — yet.
In the case at hand, one of the most horrific illegal alien crimes of the last year was the death of young motorcyclist Matthew Denice (pictured) in Milford, Massachusetts. The townspeople were infuriated that one of their own neighbors could be cruelly dragged a quarter mile to death under a truck driven by a drunk Ecuadoran who refused to stop.
The latest from Milford is an attempt on the part of the illegals and their usual cheerleader gaggle (ACLU, churches, professional ethnic mouthpieces) to ju-jitsu themselves into being seen as the victims (rather than the lawbreakers) by claiming that the Americans are MEAN to foreign colonists. Despite their job theft, crime, extensive use of social services and general mooching, the illegal aliens still expect to be welcomed like they were legal immigrants — go figure!
They are further upset that Americans want to expand enforcement and punishment to make them self-deport. The illegals characterize proposed legislation as part of a “hate” agenda when the bill is simply an expansion of basic law enforcement. Their tribe-based attitude of entitlement shows the foreigners to be unclear on the concept that American society is based on law — another reason they should leave.
Religious leaders and advocates for immigrant rights yesterday condemned what they say is harassment of Milford immigrants following the August death of a Milford man who police say was killed by an illegal immigrant driving drunk.
“People in Milford are afraid to go to the hospital. They are afraid to call 911,” said Filipe C. Teixeira, a bishop with the Catholic Church of the Americas diocese in Brockton. “We have created a state of fear.”
Teixeira was among eight speakers at a Boston rally organized by the Massachusetts Immigrants and Refugee Advocacy Coalition. The speakers took aim at what they say is growing hostility toward immigrants – from name-calling on the streets of Milford to legislation proposed by Rep. John Fernandes, D-Milford, that would place greater restraints on illegal immigrants registering cars, applying for in-state college tuition, living in public housing and looking for jobs.
“This bill was filed and explicitly tied to the recent drunk driving accident in Milford,” said Shannon Erwin, state policy director for the immigration coalition. “However, it has 24 broad-ranging amendments, most of which have nothing to do with crime but would make immigrants’ lives more difficult.”
On Aug. 20, Matthew Denice, 23, was struck while riding his motorcycle in Milford and dragged nearly a quarter-mile by a pickup truck driven by Nicolas Guaman, a 34-year-old illegal immigrant from Ecuador, authorities have said. Police say Guaman was drunk at the time of the accident, and he has been indicted on several charges, including second-degree murder.

On Thursday, several friends of immigration enforcement, including Congressmen Steve King and Walter Jones along with representatives from the FIRE Coalition and Immigration Tea Party, held a press conference near the capitol to draw attention to the crime victims of illegal aliens.
A related issue is legislation requiring comprehensive statistics on illegal alien crime from federal and local governments, something that has been sorely lacking (HR 3168, the Illegal Alien Crime Reporting Act of 2011).
Rep. Steve King has done some great work, including requesting a GAO report on illegal alien crime, which should be required reading for anyone concerned with the issue: CRIMINAL ALIEN STATISTICS, March 2011.
Congressman King’s statement at the presser was both informative and heartfelt about the victims. He emphasized the point that illegal alien crime is preventable crime.
The point is that open borders are a welcome mat to the criminals of the world who see the United States as a full refrigerator of felony opportunity. Sanctuary cities provide protection to foreign criminals that domestic thugs would love to have.
In addition there are cultural issues, particularly around drunk driving, which is considered to be desirably macho behavior among hispanics. Even NPR admits that “Latinos are responsible for a disproportionate number of DWI arrests and alcohol-related car accidents.” The deaths resulting from drunk driving illegal aliens continues to accumulate, but DHS and many local law enforcement agencies continue to treat the crime casually.

Washington D.C.- Washington D.C.- Congressman King (R-IA) joined the FIRE Coalition and the Tea Party Immigration Coalition this morning to recognize the victims who have lost their lives because of the criminal acts of illegal aliens. Since 1955, there have been 25,065 homicide arrests of criminal aliens in the United States, and King’s resolution aims to honor and mourn these preventable deaths.
“These are real human stories, there’s real pain and real agony going on on a daily basis in the United States of America, and we treat it as if it’s just some kind of tolerable interruption of our lives. It’s not. It’s an interruption of innocent lives that takes place because we have an administration that refuses to enforce immigration law.”
Usually the government prefers a plea deal to a trial in controversial cases where illegal alien criminals are involved. The details often reveal authorities’ continuing malfeasance and unwillingness to protect the public from truly dangerous foreigners.
The death of Benedictine nun Denise Mosier has been more secretive than most cases because of the embarrassment it caused DHS honcho Napolitano. The crime occurred at a time when she had been touting the administration’s supposed emphasis on prosecuting dangerous criminals rather than mere job thieves.
It was more than curious when Napolitano withheld records about the case. The whole thing looks plenty dirty, since Carlos Montano’s crash killing the nun was his third drunk-driving incident in five years. The deadly smash-up occurred after he had been released onto American streets even though he was in the midst of a removal process.
The upcoming legal proceeding will take place before a judge rather than a jury and some charges are expected to be pleaded out in advance, although there will be a camera in the courtroom to record opening and closing statements. I’m sure those will be played close to the vest to minimize any further political damage to the administration and its permissive attitude toward even the most dangerous foreign criminals.
Carlos Martinelly Montano, the illegal immigrant charged in an August 2010 crash that killed a nun, has opted to be tried before a judge instead of a jury.
Martinelly, 23, was set to go on trial before a jury Monday on felony murder and a host of other charges in connection with the fatal crash on Bristow Road. Sister Denise Mosier, 66, died and two other Benedictine nuns were critically injured.
At a hearing Friday, Prince William County Circuit Court Judge Lon E. Farris said Martinelly had opted for a non-jury trial on the felony murder charge.
The Bolivian native is expected to plead guilty to other charges, including involuntary manslaughter, two counts of maiming as a result of driving while intoxicated, driving on a suspended or revoked license and a third DWI offense within five years.
“At this point, it’s believed the other charges will be disposed of pursuant to a plea, but details are being worked out,” Farris said.
The judge also ruled that broadcast television cameras can film the plea and opening and closing statements in the trial, but not the testimony itself. Still cameras will be allowed to document the entire hearing. Continue reading this article
Homeland Security Secretary Janet Napolitano has repeatedly assured us little citizens that violent criminals were her agency’s top priority. But it’s apparently difficult to enforce the law only part of the time. As a result, we have seen failures such as the case of Sister Denise Mosier, killed by a drunk-driving illegal alien with priors who had been released from jail rather than deported.
Now we learn that an important witness, illegal alien Luis Acosta, in the dragging death of young Matthew Denice (pictured) in Milford, Massachusetts, cut off a tracking bracelet and may have escaped to Ecuador. Acosta was a passenger in the truck driven by Nicolas Guaman when he dragged Denice for a quarter mile, killing him.
(Your humble correspondent does not understand why monitoring bracelets cannot be made that are sturdy enough to resist being cut off. And why wasn’t Acosta put on the no-fly list?)
Milford Police Chief Tom O’Loughlin said he was “beside himself” with anger at the ineptitude of ICE officials and their statement that the loss of Acosta was his problem, not theirs.
As police continue to search for a witness to the accident that killed Matthew Denice, U.S. Rep. Richard Neal released the letter he sent to Homeland Security Secretary Janet Napolitano asking for a “top-down review” of policies that allowed the man to disappear.
Neal, D-2nd, yesterday echoed outrage expressed by Milford Police Chief Thomas O’Loughlin about a statement U.S. Immigration and Customs Enforcement issued Tuesday saying local jurisdictions, not the federal agency, are responsible for keeping track of witnesses in their criminal investigations.
“What is of significant concern is Immigration and Customs Enforcement’s inability to adequately share the most basic pieces of information with local law enforcement,” Neal wrote in his letter, which he sent yesterday on behalf of Denice’s family.
Police have said that on Oct. 1, Luis Acosta, 20, who was in the country illegally and lived at 10 Cherry St., Apt. 2, removed a tracking bracelet that ICE said it put on him while he waited for an immigration hearing.
Acosta was in the truck driven by Nicolas D. Guaman, 34, of 10 Cherry St., Apt. 1, when it struck Denice’s motorcycle on Aug. 20.
Local police didn’t learn that Acosta had cut off the monitoring bracelet until they asked ICE about Acosta, who had skipped a grand jury appearance Oct. 6, Neal wrote in his letter.
O’Loughlin and Neal questioned how this could happen in the post-9/11 world.
“In a time in history when we extol how we have built an extensive information-sharing network to counter terrorist activities, it alarms me that this policy failure is allowed to exist within the Department (of Homeland Security),” Neal wrote in his letter.
Police traced Acosta’s cellphone to JFK International Airport in New York.
